1 Claber S.p.A., company limited by shares incorporated and existing under Italian laws with registered office in Via Pontebbana 22, 33080 Fiume Veneto (PN), Italy (“CLABER”) guarantees that [the products listed in Schedule A hereto] (“Product/s”) will be free from defects in materials and workmanship for the period specified in Schedule A as of the date of the relevant purchase (“Warranty Period”).
The purchased date shall be proved by means of a valid fiscal document (e.g. sales receipt).

2. The services subject matter of this warranty are gratuitous and are added to, but do not substitute the rights of which the consumer is entitled at the law.
As a matter of facts, the final consumer is entitled by law to remedies from the seller free of charge in the event of a lack of conformity of the goods and those remedies are not affected by the content of the present document.

3. The claims for alleged defects of the Product/s shall be made in writing, by means of e-mail or return receipt registered letter at the following address:
Claber. S.p.A., Pontebbana 22, 33080 Fiume Veneto (PN), Italy, email account [customercare@Claber.com].
Claims shall also be submitted through the contact us page of the www.claber.com website.

4. To activate the warranty the consumer shall:
(i) have the allegedly defective Product;
(ii) present written request, with a detailed description of the alleged defect, enclosing (a) pictures of the allegedly defective Product/s and (b) copy of the sales receipt or other valid document attesting the relevant purchase;
(iii) indicate the address of its residence and of the store/sale point where the Product was purchased, to allow the delivery of the substitutive Product as per art. 5 below;
(iv) state that the Product has been used solely for private purposes and not for commercial or professional purposes.

5. Should the complaints raised by the consumer within the Warranty Period pursuant to art. 4 above, be grounded and accepted by CLABER, the latter will, free of charge for the consumer, replace the defective Product/s by delivering the substitutive new Product/s at its discretion (i) at the consumer’s residence or (ii) at the sale point/store where the consumer originally purchased the defective Product/s.
The substitutive Products will be delivered or placed at the consumer’s disposal by CLABER in a reasonably short term as of the date of acceptance of the consumer’s claim.

6. Upon CLABER’s request, the consumer shall allow CLABER to examine the defective Product/s.

7. This warranty shall be deemed as entirely fulfilled by CLABER with the replacement of the defective Product, without any additional duty and/or obligation on its account.

8. CLABER’s obligations under this warranty are based on the private use of the Products and are therefore expressly excluded in case of any use of the Products for commercial or professional purposes.

9. The warranty will not apply to any defect of the Products arising out of:
(i) normal wear and tear of the materials.
(ii) warehousing in non-suitable place.
(iii) improper use and/or contrary to the conditions of use and warnings set out under the products technical specifications.

11. This warranty applies only on Products purchased by consumers in the following countries: Europe, USA, Africa, Asia.

12. This warranty is governed and shall be construed in accordance with the law of Italy, save and without prejudice to the rights granted to the consumer by the law in force in the place where he purchased the Product/s that cannot be contractually derogated.
